  • Mine at last

After 2+ years and $1500 in lawyer fees, the FAA has finally accepted that I am the owner of N96421. Long story short. The previous owner (a long time friend) died eleven years ago. His widow sold it to me in October 2008. the FAA rejected the sale since the seller (also the executor for the estate and so approved by probate judge) was not the registered owner. I supplied them with copies of all of the available court documents, but the A/C was not specifically listed as an asset in the will. Despite the fact that NH court recognizes that "all personal and real property" to be inclusive of same, the FAA's position was "We're the Federal Government, we aren't interested in NH law." So, I had to get a judge to re-open the estate, add the A/C as an asset and declare the widow the executor for said asset.

At any rate, that battle is finally over. Time for celebratory beverage.

It always helps if we have our affairs in order.

Right now I'm involved with 2 aircraft that the non-flying families would like to part with.

Always helps to have the Bill of Sale signed before you meet your maker.

I also think it EXTREMELY cruel when "friends" place a value on the aircraft that is not in line

with current aircraft & market conditions.

In my case the problem was with the Feds, not the seller. We really need to clean house in D.C. and stop the madness.

I not sure of your Sales Tax status ; if any.

Be aware many states do not consider it due until the aircraft is "Placed into Service".

However; many Civil Serpents are unaware of the policy & want penalties & interest from the date on the B of S.

I don't want to pee in someone's pond but it's too late once you pay.

Fortunately, there is no sales (or income) tax in NH (except rooms and meals and tobacco and gas and booze etc., but not A/C).

Yep, I bought my Taylorcraft in 07 as a basket case, 3 years later the state found the new fed registration with my name and sent me a little note saying in essence "we are not accusing you of anything but if you owe the state of Illinois money send it to us and no questions will be asked"! I called and asked: what the hell are you talking about, as I owed nothing to anybody. Well the state said if I had bought this plane I owed them sales tax. It used to be if you bought from a private individual there was no tax due but the bureaucrats decided they were losing to much money on private cars sales so "Wallah!" I owed them money! Probably naive on my part but it still rankles me!
