  • Herrick Amendment status

    Does anyone know if the Herrick Amendment that was to be part of the 2012 FAA modernization act was passed/enacted?

    If not, is it part of the current authorization legislation? Seems to be no relevant current info. I can find.

    I"ll bite.

    What is the Herrick amendment?

    Is that a combination of 2nd amendment and the 15 amendment?

    I can posses a gun in the booth and pull a voting lever at the same time?

    Sort of combing both ways to shoot myself in the foot?

        Thanks Terry! I'll give that a read through. How did this not get more aviation press in the antique world?

        The Herrick amendment could be extremely important to owners of antique aircraft.

        In 1997 Greg Herrick: http://www.goldenwingsmuseum.com/owner/owner.htm
        wanted a drawing for restoration of a Fairchild model 45. His request was denied by the FAA because it contained trade secrets of design. They did not allow the fact that it was an antique and Fairchild was no longer in business.

        He took it to the Supreme Court and won, got his info. He then got congress to write and add an amendment to the FAA funding bill in 2012 that they must preserve all Type Design Data for certs (ATC) 1 through 713 and TCs 2-1 through 2-544

        In addition to the preservation of data, it requires them to release it thru a request process by and to individuals with some caveats on use of the data.

          Interesting information. I remember reading about this some time in the past but did not read anything further about it. It is a travesty it took fifteen years to get it done.

              I should have asked him while he was here in town yesterday. Our GA ramp was closed and sterilized for nine hours even though he was here for only six.

                        The double-posts have been constant for some time, seeming to inflict themselves on particular folks like Rob Lees, etc. Dave's took an hour to double-post itself, that is why I pointed it out....something new for the forum. Can you tell it is the middle of winter???
